The Etapharma Affiliate Program, available at app.etapharma.com, allows Affiliates to promote Etapharma products and earn commissions on sales generated through their links or codes. Participation implies acceptance of these Terms and Conditions, which govern membership, tracking, commissions, Affiliate obligations, and use of official materials.
This document governs the participation of the affiliate (hereinafter, “Affiliate”) in the Affiliate Program managed by Etapharma S.r.l. (hereinafter, “Etapharma”).
“Affiliate Link” means any link, code, coupon, or tracking mechanism provided by Etapharma to correctly attribute sales generated to the Affiliate.
2.1. Enrollment follows procedures specified by Etapharma and may be subject to identity verification and promotional channel quality assessment.
2.2. Etapharma reserves the right to accept or reject any request at its discretion, without obligation to provide reasons.
3.1. Sales are attributed to the Affiliate through Affiliate Links or other tracking tools provided by Etapharma.
3.2. Attribution occurs if:
(i) the customer accesses the site through a valid Affiliate Link;
(ii) the purchase is completed within the active attribution window (e.g., 30 days);
(iii) the order is properly paid and not canceled, refunded, or subject to chargeback.
3.3. Unless otherwise specified, the last valid click logic applies.
3.4. Etapharma may update tracking tools and criteria for technical or compliance reasons, with prior notice.
3.5. Attribution window and special cases:
(a) Reopened carts: orders completed after reopening are included in the window if made on time;
(b) App vs Web: attribution guaranteed only with deep-link and SDK correctly active;
(c) Cross-device: possible only if supported by adopted technologies;
(d) Offline orders/third-party channels: excluded unless specific integrations are announced on the platform.
3.6. Exclusions. Commissions are not earned for orders that are canceled, refunded, in chargeback, suspected of fraud or that violate these Terms (e.g., self-referral).
3.7. Tracking Reliability. Tracking operates on a best-effort basis; Etapharma does not guarantee 100% availability/accuracy due to external factors (ad-blockers, cookie blocking, third-party downtime). In case of incidents, Etapharma may apply
4.1. The Affiliate earns a percentage commission on valid generated sales. Percentages may vary and are shown on the platform.
4.2. Percentages are gross. The Affiliate is responsible for their own tax obligations.
4.3. Payments are made monthly when exceeding the minimum threshold of €100.
Commissions for returned/canceled orders are not earned; amounts already paid may be reversed or offset.
4.4. The currency is Euro (EUR). Payment methods and details are specified on the platform. Tax documentation or invoice may be required.
4.5. Any disputes must be submitted within 30 days of report publication.
The Affiliate agrees to:
5.1. use materials and links in an ethical, legal, and compliant manner according to these Terms;
5.2. not make false, misleading, or unverifiable statements;
5.3. clearly disclose the promotional nature of the communication (e.g., “advertisement”, “sponsored content”, “affiliate link”);
5.4. respect intellectual property rights;
5.5. comply with all applicable regulations (advertising, consumer, competition, privacy, cookies);
It is strictly forbidden to:
Etapharma may perform cross-checks, reverse commissions, and immediately exclude the Affiliate in case of violation.
Medical or therapeutic claims are prohibited (“cures”, “heals”, “replaces therapies”, quantitative promises).
Only authorized nutritional/health claims are permitted.
Mandatory warnings required.
Required examples:
Prohibited activities include, but are not limited to:
6.1. spam, cloaking, cookie stuffing, unauthorized incentives;
6.2. bidding on keywords containing Etapharma brands, similar domains, misleading meta-tags;
6.3. publishing codes in self-purchase circuits;
6.4. unauthorized discounts or untruthful comparisons;
6.5. fraudulent activities, tracking manipulation.
7.1. Limited, non-exclusive, and revocable license to use official materials.
7.2. Unauthorized modifications or uses harmful to company image are prohibited.
7.3. Immediate removal of materials upon request.
8.1. Offensive, illegal, or dangerous content prohibited.
8.2. Reviews/testimonials must be authentic.
8.3. Email marketing allowed only with valid consent.
8.4. Paid advertising allowed in compliance with SEM Policy.
Rules on publication, prohibitions on coupon aggregators, non-stackability, prohibition on presenting codes as “official” without authorization.
Cold emails without consent, unmoderated private groups, adult/gambling content, broadcast without opt-in, push notifications without consent.
9.1. Parties process data in compliance with GDPR.
9.2. Affiliate does not acquire customer data without authorization.
9.3. Cookie usage requires adequate compliance and consent.
10.1. Etapharma may perform traffic and conversion checks.
10.2. Payments may be suspended in case of anomalies.
10.3. In case of fraud → immediate termination.
10.4. Affiliate must provide reports within 5 business days.
10.5. Payment hold up to 60 days during investigations.
10.6. Application of risk-scoring systems possible.
10.7. Etapharma may initiate audits with notice.
11.1. Contract for an indefinite period.
11.2. Termination with 15 days notice.
11.3. Immediate termination for serious violations.
11.4. Earned commissions paid according to regulations.
Obligation to maintain confidentiality of non-public information, even after termination.
Etapharma is not liable for indirect damages or commercial losses.
Affiliate indemnifies Etapharma against damages, penalties, or costs arising from violations.
Etapharma may modify Terms with minimum 15 days notice.
No liability for unforeseeable or uncontrollable events.
Parties are independent; no agency or employment relationship.
Affiliate cannot assign the contract without written consent. Etapharma may assign it in case of reorganization.
Independent clauses; no tacit waiver of rights.
Governed by Italian law. Exclusive jurisdiction: Caltanissetta.
By participating in the Program, the Affiliate declares to fully accept these Terms.
